Garment Rentals
Our Delite Designs Rental Agreement covers a multitude of parameters for both parties that must be agreed upon prior to rental terms.
We make sure all areas are covered with our contracts- ensuring that we clearly identify the parties involved, and state the purpose of the contract, specifying that Delite Designs is renting garments to the renter for defined uses such as events like editorial shoots, or display.
We include specific agreement terms (for example “Garments,” “Rental Period,” “Delivery,” “Return,” and “Permitted Use”) and attach an itemized inventory with descriptions, sizes, identifying marks or numbers, and pre-rental condition notes or photos to avoid later disputes.
The rental period will be specified with precise start and end dates and times, including procedures for extensions and late return (late return fees, coverage of potential negligence and damage of garments during rental period, etc) .
We include descriptions of responsibility for shipping costs, risk in transit, and who arranges or pays for courier services.
Fees and payment terms are explicit, showing the rental fee schedule, taxes, accepted payment methods, security deposit amount and conditions for withholding, and cancellation or refund rules. Delite Designs requires a temporary hold on the amount of each garment rented, refundable upon return, as well as a non-refundable charge of 35% of the rented garment.
Use and care obligations within the contract explain permitted and prohibited uses, required handling and cleaning instructions.
Damage, loss, and repair provisions are explicitly distinguished from normal wear from damage; clarify renter liability for stains, tears, missing embellishments, or total loss.
Assessment upon rental return will determine repair or replacement costs. Insurance and indemnity clauses state whether the renter must carry insurance or purchase a damage waiver, and include indemnification protecting the brand from third-party claims arising from the renter’s use.
Intellectual property, publicity, and image rights confirm that the brand retains design and trademark rights, set rules for photographing or promoting the garments, and specify any required approvals, attribution, or model-release responsibilities.
Confidentiality and exclusivity terms protect unreleased or proprietary designs and, if relevant, restrict the renter from using competing brands during a campaign.
Termination clauses include required grounds for immediate termination, the renter’s return obligations upon termination, and the handling of prepaid fees. The agreement is set by the relevant governing laws/ dispute resolution process, whether mediation, arbitration, or court proceedings, and addresses recovery of legal costs if applicable.
Finally, standard miscellaneous provisions will cover assignment, force majeure, amendment procedures, notice requirements, and an entire-agreement clause, followed by signature blocks with contact details and dates. Including a short operational checklist—booking information, ID verification, condition photos, and a delivery/return checklist.
